In its judgement of 12 May 1998 on “Liability for Links” (312 O 85/98), the Hamburg Regional Court ruled unambiguously that by placing a link on a website, one may be held jointly responsible for the content of the linked page, i.e. liable; this can only be prevented by expressly distancing oneself from this content.
